Tulum, Quintana Roo — A buyer has publicly accused the Riviera Maya developer Menese of failing to deliver two apartments she says she paid for in 2023, and she is now seeking other affected purchasers to explore a joint class action.
Heidi Rojas Luna said she bought the units in June 2023 — one in the Menesse Cobá development in Tulum and another at Menesse Coco Beach 3 in Playa del Carmen. She said neither property has been handed over, which led her to speak out after months of waiting.
Rojas Luna said she is now collecting documents and testimony from other buyers who may have faced similar delays, non-delivery, or other breaches of contract. She hopes to determine whether enough cases exist to file a collective complaint with the appropriate authorities.
The case follows a separate complaint made public earlier by Jorge Luis Ocaña Jiménez, who said he paid $97,000 for an apartment linked to a Menese development in Tulum. He said the property was expected to be delivered around 2020, but the deadline was later changed and disagreements arose over financial compensation for the delay. Ocaña Jiménez said the dispute went to court and is now part of an amparo, a Mexican constitutional appeal process.
He also said he received charges for services tied to the property that, according to his account, he never used or occupied.
Both sets of claims are currently public allegations by individual buyers. Any finding of contractual breach or legal responsibility would rest with the competent authorities, and the company is entitled to present its own position, evidence, and defense in the relevant proceedings.
