Mexico Supreme Court Strikes Down Heyden Cebada Term Extension, Reshapes Quintana Roo Judiciary
Mexico City — Mexico’s Supreme Court (SCJN) has declared unconstitutional the term extension that would have kept Heyden Cebada Rivas as a magistrate on the Quintana Roo Superior Court of Justice until 2033, ruling that the extension violated the federal constitution’s judicial election framework.
The decision, approved by eight votes to one, also invalidated several other aspects of the state’s judicial reform, including the composition of the Superior Court chambers, the appointment of a magistrate to the Juvenile Unit Court, and the procedures for selecting the heads of the Judicial Discipline Tribunal and the Judicial Administration Body.
The court ordered the Quintana Roo Congress to make the necessary legal adjustments to ensure the judiciary continues functioning without disrupting the administration of justice.
The ruling is one of the most significant regarding the implementation of judicial reform at the state level and reinforces the principle that local legislatures cannot extend magistrates’ terms through transitional provisions to avoid subjecting them to the new judicial election system.
