Playa del Carmen, Quintana Roo — Gilberto N, the former mayor of Puerto Aventuras who was ordered to stand trial on aggravated extortion charges, has filed a federal injunction against the arrest warrant used to detain him, court records show.

The amparo petition was lodged with the Fourth District Court in Cancún, which has so far only received the filing. According to the court’s daily docket, the case was registered as expediente 1448/2026.

The former mayor is challenging what his filing describes as acts depriving him of his liberty, specifically the arrest warrant and its execution, tied to administrative file 451/2026 and investigation file FGE/QROO/SOL/06/440/2025.

The petition names the oral and family court judge attached to the First Family Oral Court of First Instance in the Cancún judicial district.

Arrest and charges

State Prosecutor’s Office investigators assigned to the unit specializing in kidnapping and extortion arrested Gilberto N on October 15, along with Karla Paola N and Jorge N. The three were taken into custody under warrants issued by a control judge.

Prosecutors accuse the former mayor, one of his relatives and an employee of the Puerto Aventuras municipal government of demanding payments under threats from a local merchant in the community, which sits just south of Playa del Carmen.

The State Prosecutor’s Office presented evidence that persuaded the control judge to bind the suspects over for trial and impose two years of preventive detention while the case proceeds.
