Calica Files Appeal Against Federal Court Ruling in Environmental Dispute

Playa del Carmen, Quintana Roo — Calizas Industriales del Carmen (Calica), a US-owned company, has filed an appeal against a federal court ruling that upheld the closure of its La Rosita quarry, escalating a legal battle with the Mexican government over environmental enforcement.

The company submitted a recurso de revisión (review appeal) to the Seventh District Court, which has now been forwarded to the Collegiate Court of the 27th Circuit. The appeal challenges a May 2026 decision that dismissed Calica’s amparo (constitutional injunction) lawsuit against the federal government.

The original amparo, filed in 2022, targeted actions by former President Andrés Manuel López Obrador and other authorities, alleging violations of constitutional rights under Articles 14 and 16. The dispute stems from an environmental impact inspection that led to the closure of the La Rosita site on May 5, 2022, for unauthorized extraction activities.

In September 2022, an appellate court confirmed the dismissal of a complaint filed by the authorities against an earlier procedural ruling. By May 2026, the court notified Calica that the case was dismissed because the legal situation had changed: in May 2024, the environmental agency issued a final administrative resolution imposing sanctions, closure, and corrective measures. The court deemed the alleged violations irreparably consummated, rendering the amparo inadmissible.

Calica has pursued other legal actions, but this specific case represents another setback for the company, prompting the latest appeal.
