The Supreme Court of Justice of the Nation (SCJN) has ruled in favor of the government in a constitutional dispute initiated by the Municipality of Solidaridad, now known as Playa del Carmen. The court's decision invalidates a provision that previously allowed real estate developers to avoid providing land for public facilities. This ruling, passed by a majority vote on Tuesday, April 9, 2025, directly impacts regional developments, requiring developers to allocate areas for public infrastructure such as parks, schools, and other community services.
The dispute originated from new clauses in the Urban Actions Law, the Human Settlements, Territorial Arrangement and Urban Development Law, and the Ecological Balance Law, all of which were published in August 2023. These laws altered the requirement for developers to provide land for community welfare. The Municipality of Playa del Carmen, under its previous administration, instigated the dispute, arguing that the exemption was essential for the region's economic development.
However, the court, by majority vote, ruled that such an exemption is not valid and must be overturned. As a result, developers are now obliged to surrender lands intended for public infrastructure, bolstering the government's efforts to ensure public spaces for community benefit.
The case had been postponed several times due to a lack of quorum in the court. However, the ministers finally resolved the dispute by majority vote, without accepting a new hearing request from the state government. The resolution has been welcomed by those who believe this measure is crucial to ensure the orderly growth of Playa del Carmen and to maintain the quality of life for its residents.
