Tulum Condo Workers Allege Unpaid Wages After Management Shift

Workers at Ophelia condominium in Tulum protesting labor violations

Tulum, Mexico — A group of workers at the Ophelia condominium in Tulum has expressed dissatisfaction over alleged labor irregularities committed by the company BB Condos following a management change recorded in early December. According to the employees, the company abruptly disclaimed its responsibilities, leaving more than eight workers who were part of the daily operation of the complex in uncertainty.

The workers indicated that they worked at least 10 days without receiving payment, in addition to not being granted year-end bonuses, vacations, or severance pay, benefits considered mandatory under Mexican labor legislation. They also stated that none had formal contracts, a situation they claim was the direct responsibility of the company in charge of the outgoing administration.

According to their account, the notification of the disclaimer of responsibilities was carried out informally and at the last minute, through a document that, besides lacking official validity, contained spelling errors and lacked clarity. The employees point out that this notice was issued by a person identified as Víctor García, who presented himself as the company’s manager, while the owner of BB Condos, Gabriel Bergas, did not come to the condominium to address the situation or speak with the affected staff.

Faced with this problem, the workers went to the Conciliation and Arbitration Board to initiate a formal process and request the intervention of labor authorities. They are currently awaiting a resolution that will ensure compliance with their rights and benefits.

The affected group emphasized that their intention is to publicly record what happened, as they said the lack of clarity, professionalism, and responsibility on the part of the company has created an environment of vulnerability and economic uncertainty for those who contributed to the operation of the condominium.

The employees reiterated that they will continue the corresponding legal process and expressed confidence that the competent authorities will issue a resolution that allows them to recover the benefits and pending payments derived from their employment relationship with BB Condos.
