Cancún — A federal judge has put feminist collectives and children's rights groups in Quintana Roo on alert due to the imminent possibility that the alleged sexual aggressor of his own four-year-old daughter could obtain his freedom this Friday through a legal injunction known as an amparo.
The case, which is being pursued under investigation files FGE/QROO/SOL/05/3844/2024 and 25627/2023, has generated profound social indignation over the alleged physical, psychological, and sexual abuses the young girl is said to have suffered while in her father's care.
The complaint was filed by the girl's mother, who recounted a history of family and vicarious violence preceding the abuses. The situation worsened in 2023 when the mother was forced to travel to Colombia for emergency surgery. Before her departure, the father denied her permission to take the child and blocked her access to the girl's documents.
According to the investigations, it was during the mother's absence—a period when the girl was with the father, the paternal grandmother, and a domestic employee—that the alleged crimes are said to have been committed.
Upon returning to Cancún, the mother faced months of obstacles, denouncing alleged corruption and extortion by officials from the Women's Prosecutor's Office, including the then-prosecutor Nathaly Robertos, who allegedly demanded money from her in order to see her daughter.
Thanks to pressure from civil organizations and collectives, the case managed to advance. The girl was safeguarded by the DIF of Playa del Carmen and her testimony was collected in a Gesell chamber, where she narrated the alleged abuses before various authorities.
As a result of this testimony, an arrest warrant was issued against the father, who remained a fugitive. However, the accused recently reappeared, promoting a federal amparo before the Fifth District Judge, Alonso Robles Cuétara, seeking to reverse the charges and obtain his immediate freedom.
"I saved my own life so I could save my daughter's. Today, I fear the judge will return her to her aggressor," declared the mother, who states she has irrefutable medical and legal evidence.
Faced with the possibility of the alleged aggressor being released, the collective supporting the girl's mother has called for a demonstration this Friday in front of the Federal Judicial Power facilities in Cancún. The organizations warn that if the amparo is granted, the ruling would be "a new display of impunity and corruption" that would re-victimize the girl and her mother, and they demand that authorities guarantee justice and the protection of children in Quintana Roo.
