Court Upholds Environmental Closure of Royal Caribbean’s Perfect Day Water Park in Mahahual

Mahahual, Quintana Roo — Royal Caribbean’s plan to build the Perfect Day water park in Mahahual suffered another legal setback after a federal court upheld an environmental closure order against the project site. The ruling confirms a January decision by Mexico’s Federal Attorney for Environmental Protection (Profepa) to shut down the area where the cruise line’s subsidiary, Promociones Turísticas Mahahual, planned to develop the resort.

The company had filed for an injunction against Profepa’s closure, arguing the agency lacked proper legal and environmental grounds for its action. While the firm obtained a provisional suspension in March, a federal judge this week denied its request for a permanent injunction, citing Profepa’s authority in the case.

The court’s decision, issued Tuesday, states it “denies the plaintiff’s request for a definitive suspension regarding the acts challenged against the authorities indicated as responsible, in accordance with the considerations.” The case is filed under docket number 221/2026 in the First District Court.

Profepa originally ordered the closure through administrative procedure PFPA/29.1/3S.4/0001-2026. The company also challenged a press release Profepa issued about its enforcement actions, claiming it violated constitutional guarantees of legality.

The Perfect Day project has divided local residents and organizations over its potential environmental and community impact. The civil association Defending the Right to a Healthy Environment (DMAS) successfully obtained another injunction halting land-use changes for the project, effectively blocking any permits Royal Caribbean might need to proceed.

The future of the water park remains uncertain as legal challenges continue to shape the conflict between corporate, environmental, and social interests in this coastal community.
