Cancún — The Employers' Confederation of the Mexican Republic (Coparmex) has warned that real estate fraud continues to represent a challenge to legal security in Quintana Roo, despite advances in regulatory matters.
Digital Tools to Review Property Status
Mario González Pliego Gutiérrez, a specialist lawyer in corporate, civil, and commercial law for Coparmex, stated that although more legal filters and safeguards now exist to prevent such fraud, cases still occur.
He highlighted that the state's Public Registry of Property and Commerce already has a digital platform that allows users to consult the legal status of a property from a cell phone or computer, download certified copies, and verify lien certificates with an electronic signature.
Regarding the sale of ejidal lands (communal lands), González Pliego emphasized that this is a matter of agrarian jurisdiction, falling under the competence of federal courts and the Office of the Agrarian Prosecutor, which are responsible for addressing conflicts arising from double sales or irregular transfers of rights.
Alert in Tulum
Just yesterday, the Secretariat of Sustainable Territorial and Urban Development (SEDETUS), in coordination with the Tulum City Council, issued an alert regarding 26 real estate developments operating without permits or legal authorizations in the state.
Among the detected projects are: Luna Sanctuary, Santuario Uh May, Uxcan Tulum Bamboo Villas, Haciendas Coba, Viventum, Nova Tulum, Maia Holistic Community, Selvadentro, Akun, Arunte, Emana, Tulum Cenote Gardens, Oken, Ilik Ha, Selvarum, Ulumi, Rosela Tulum, Trebola, Bosque Tulum, Cosmos, Zool, Xeelenja, Nero, Iktan, Cibelia, and 528 Tulum.
The state agency specified that these developments violate the Human Settlements Law, the Law on Urban Planning Actions, and the Condominium Property Law. Therefore, buying, selling, or renting in them not only implies a financial risk but could also lead to legal liabilities.
