A will is a legal document that defines the destination of a person's assets and rights, and it can avoid lengthy judicial processes and family conflicts. According to information published in the Revista del Consumidor, September is a key month to consider this procedure, as notaries across the country are offering discounts and special arrangements.
The Cost of the Procedure
The price for granting a public open will (the most common type in Mexico, performed before a notary) varies depending on the state. In a notary office, the regular cost ranges from 1,160 to 3,734 pesos, although in September it can be reduced by up to 50% thanks to the national "Mes del Testamento" (Will Month) campaign.
This means that during this season, a person could prepare their will for less than half the usual cost, with the added advantage of receiving free advice to clarify doubts and leave the document in order.
More Than a Procedure, an Act of Prevention
Creating a will is not exclusive to those who possess a large estate; it is an accessible decision for any person who wishes to ensure legal certainty and peace of mind for their loved ones.
Among the points that can be established are:
- Naming an executor, responsible for distributing the assets.
- Designating a tutor for minor children.
- Appointing a curator to supervise the fulfillment of those functions.
- Leaving specific assets to a legatee.
- Including the decision to grant a food pension to a particular person.
What Happens If There Is No Will?
In the absence of this document, an intestate succession trial begins. This involves summoning potential heirs, making inventories and appraisals, and following a longer and more costly process before the courts.
In contrast, with a will, the heirs go directly to the notary office, the expressed will is fulfilled, and uncertainty is avoided.
This month is an opportunity to take the step, as besides the discounts, there are special sessions and state programs that facilitate the procedure.
