Yucatán to Dissolve INAIP: What Comes Next?

Mérida, Yucatán — The Government of Yucatán is preparing a reform initiative to comply with the federal constitutional mandate to dissolve state-level access-to-information agencies. The Legal Counsel’s Office confirmed that the proposal is currently under review, involving complex adjustments across multiple public institutions, including budgetary, logistical, equipment, physical space, and technological infrastructure considerations.

Transition Plan and Legislative Process

The proposal is expected to be submitted to the State Congress next week, though the exact timeline for discussion remains undetermined.

Which Entity Will Replace INAIP?

Under the reform, the Secretary of the Comptroller’s Office (Secretaría de la Contraloría) will assume the functions of the current Transparency Institute (Inaip). Additionally, a new transparency-focused body will be established under the Secretary of Anti-Corruption and Good Governance, a new agency to be created as part of the regulatory changes.

Gaspar Alemañy Ortiz, head of the Legal Counsel’s Office, anticipates a transition period of approximately three months to implement necessary adjustments, allowing citizens and institutions to adapt to the new structure. The initiative also includes reforms to secondary laws, such as the Transparency Law and the Public Administration Code, to ensure uninterrupted operations.

When Will INAIP Yucatán Be Dissolved?

The federal deadline for transitioning to the new National Transparency System—which excludes state-level agencies—is June 20. Alemañy Ortiz acknowledged the tight timeline, stating, “I don’t think we’ll meet that date, but we will resolve it with secondary initiatives.” He emphasized that approval of the local constitutional reform by the State Congress is still pending and must be finalized in the coming days.

The reform aligns with broader federal efforts to streamline transparency mechanisms, though its implementation hinges on legislative approval and subsequent operational adjustments.
