Hotel La Tortuga and Other Properties Returned to Rightful Owners
Five Properties in Playa del Carmen and Tulum Recovered by the Anti-Corruption Prosecutor’s Office of Quintana Roo
The Anti-Corruption Prosecutor’s Office of Quintana Roo announced the recovery and restitution of five properties in Playa del Carmen and Tulum, which were taken from their owners. Among them the Hotel Tortuga in Playa del Carmen, which had been illegally given to Andrea Guiseppe Sabbia, former honorary consul of Italy in Playa del Carmen. After acts of corruption were confirmed, the hotel was returned last week to its legitimate owners.
In an interview, the legal representative of the companies that were returned to their properties, Rodolfo Ruiz Sanchez, explained that after the integration of the investigation files, on June 7 before the Judicial Control Body, two hearings were held. The Control Judge determined that due to the evidence contained in the investigation files, the seizure of the Hotel La Tortuga and an annex property was appropriate. The court ordered the judicial authority to the Prosecutor’s Office for Combating Corruption its execution, after the victims’ rights had been restored.
Last November 27, 2020, by means of an illegal agreement issued by the Public Prosecutor Ernesto Rodriguez Soria, the legal entities “Representaciones RS21” S.A.P.I de C.V. and “Kite and Sub Board Center” S. A. de C. V. were illegally dispossessed of their properties, the Hotel La Tortuga, and the latter of a property annexed to said hotel.
The seizure and restitution of the two properties, located on 10th Avenue and 14th Street, was carried out last Monday, June 7, but it was not until today that the results were made public.
The litigants congratulated the work carried out by the Anti-Corruption Prosecutor’s Office, headed by Rosaura Villanueva Arzapalo. The team was able to successfully integrate the investigation files against the Prosecutors of the Public Prosecutor’s Office who dispossessed properties from individuals who had legal rights to them.
He also acknowledged the work of the Special Prosecutor’s Office for Combating Corruption in favor of the victims of these crimes. With actions such as this, the confidence to invest in this touristic destination can be recovered and it is assured that there is a rule of law and the law is respected.
This action implied the initiation of possible legal proceedings against the Public Prosecutor Ernesto Rodríguez Soria, who exceeded his powers in November of last year and gave possession of the hotel to Andrea Guiseppe Sabbia.
He indicated that in view of this, a complaint was filed before the Specialized Anti-Corruption Prosecutor’s Office for the unlawful use of powers and faculties of a public servant for having illegally dispossessed the aforementioned legal entities.
Sabbia illegitimately took possession of the hotel with teh participation of the Public Prosecutor of the State Attorney General’s Office and certain Municipal officials of Solidaridad.
