Playa del Carmen, Quintana Roo — December 31, 2025 A section of public beach at Calle 8 in Playa del Carmen has been partially blocked off in what residents and authorities describe as a clear violation of Mexico’s Constitution and federal law protecting free access to the country’s coastlines.
According to reports, for approximately three weeks a foreign concessionaire operating a restaurant has installed wooden structures within its concession area, removing sections of the coastal dune and filling the space with sand. The area was then cordoned off using boards, ropes, plants, and furniture, obstructing the free passage of beachgoers. Vegetation from the dunes was reportedly relocated to the side of the beach and even into the adjacent street.
The restaurant operates within The Carmen Hotel, a property described as U.S.-owned, with operations subcontracted to a Spanish group and a Brazilian restaurant tenant.

On Wednesday afternoon, personnel from the Zona Federal Marítimo Terrestre (ZOFEMAT) arrived at the hotel to address the situation with the concession holder. While some of the obstructions were partially removed, authorities confirmed that the free passage along the beach remains blocked, in addition to tables, loungers, and umbrellas still occupying the area.
Under Article 27 of Mexico’s Constitution and Articles 119 and 154 of the General Law of National Assets, beaches are public property and guaranteed for free access. The law explicitly prohibits barriers or fees restricting entry and establishes fines ranging from 3,000 to 12,000 UMAs for violations.
Beyond limiting public access, the situation is also affecting nearby beach clubs and restaurants, particularly their ability to operate and receive essential services such as LP gas deliveries. Critics warn that the most serious concern is the continued attempt—allegedly under the cover of a concession that carries strict limits—to restrict access to the beach and alter protected coastal dunes. Authorities are expected to determine whether further sanctions or corrective measures will follow.
Similar complaints have been files against other beach clubs in Playa del Carmen and Puerto Aventuras.
