Bacalar, Quintana Roo — The Federal Public Defender’s Office, representing children in the region, has not remained idle and has challenged the reactivation of construction work on a military rest house in Bacalar, which had been authorized in favor of the Secretariat of National Defense (Sedena) by federal judge Eugenia Valencia Hernández.
The agency filed an appeal for review against the ruling issued by the judge on November 4, which denied a definitive suspension to children from Bacalar against the construction of the military rest house that Sedena is carrying out on the shore of the Seven Colors Lagoon.
The project, called the military rest house, was recently reactivated after the three amparo injunctions that had suspensions in place were overturned in rulings on constitutional protection proceedings issued under unclear circumstances and contrary to mandatory jurisprudence on legitimate interest that had already been established by the Supreme Court of Justice of the Nation.
The Public Defender’s Office has sued through amparo proceedings various authorities responsible for the execution of the project, among which the Secretariat of Environment and Natural Resources (Semarnat) stands out for having condoned the execution of the work without environmental impact permits.
For the moment, the appeal for review has not been admitted, and in the coming days it will be determined which Collegiate Circuit Court should handle it.
This concerns the indirect amparo lawsuit related to case file 313/2025, requested by children from Bacalar and which at one point had a provisional suspension that prevented the armed institution from carrying out work.
These three amparo lawsuits are particularly noteworthy because before the entry of the new Judiciary, they had been granted amparo suspensions.
The new judges and magistrates who took office in September after participating in the judicial election decided to withdraw the precautionary measures with which they had benefited the federal agencies.
