The decision to cancel the waste collection concession held by Redesol has been reversed. The company won an injunction against the Solidaridad government from the Constitutional Chamber of the Judiciary of Quintana Roo. The news was announced by Adrián Pérez Vera, the Town Council's Trustee, in an interview before the Council's seventieth regular session.
Redesol was initially granted the concession for waste collection service in Playa del Carmen's tourist area during Filiberto Martínez's tenure. However, it was later withdrawn by Mauricio Góngora, resulting in a lawsuit. The current government was forced to reinstate the company, despite its lack of capability to provide the service. This led to a vote to intervene and cancel the concession.
Redesol won an injunction in May against the cancellation of the concession. The company argued that the Town Council had not respected the concession granted in 2012 for waste collection for a 20-year period in Playa del Carmen's tourist area and other parts of Solidaridad.
After a series of challenges, the Second Collegiate Tribunal of the Circuit in Cancun unanimously ruled in favor of Redesol a few weeks ago. The company had filed an appeal for review after the Second District Court denied the injunction. The Collegiate Tribunal found in favor of Redesol due to an oversight by the Constitutional Chamber, which had not evaluated a piece of evidence, rendering the initial sentence ineffective.
Despite not having the necessary machinery or staff to be reinstated, Redesol managed to win the injunction. The Council session that followed the interview aimed to reach an agreement for "the Legal Secretariat to comply with this resolution of the Court, in order to notify Redesol with information related to the technical proposal."
Now, the company must inform the Council of which routes it will cover prior to a new reinstatement.
