Mexico Enforces Total Ban on Vapes and E-Cigarettes

Mexico — A total ban on the sale, manufacture, distribution, and advertising of vapes and e-cigarettes took effect across Mexico on Friday. The reform to the General Health Law, approved by the Congress of the Union and published in the Official Gazette of the Federation, eliminates any prior authorization and establishes criminal penalties and economic fines.

Although the prohibition on importing and selling these electronic devices began in 2022, the total and constitutional ban, which toughens penalties for sale and manufacture, was consolidated in December 2025 and took effect this month.

Francisco Bonetta, Commissioner against Addictions in Quintana Roo, stated that the Federal Commission for the Protection against Sanitary Risks (Cofepris) will be responsible for monitoring and enforcing compliance due to public health risks. In this tourist hub, there are at least 10 vape shops; however, in street markets, there are more than 30 stalls selling these products.

On social media, advertisements can be seen such as: “promotion: 10 vapers of various flavors for 750 pesos. Additionally, the price of these electronic devices is not that cheap, as a disposable one costs between 200 to 600 pesos.” Although currently there is a proliferation of very economical Chinese vapes costing up to 75 pesos.

The National Health and Nutrition Survey (Ensanut) indicates that 3.5% of people aged 10 to 19 in Quintana Roo are regular consumers, and 7.8% of adults. The commercialization of these products carries a fine ranging from 95,000 to 385,000 pesos.
