Playa del Carmen Drops Urban Compliance Certificate Rule

Playa del Carmen, Quintana Roo — Residents of Playa del Carmen will no longer need to obtain an urban compliance certificate, a document previously required for construction projects in the municipality. The Supreme Court of Justice of the Nation (SCJN) ruled that the requirement infringed upon the municipality’s exclusive authority over land use regulations, as established in Article 115 of the Mexican Constitution.

Court Ruling Invalidates State-Mandated Requirement

The decision stems from a constitutional challenge filed in 2023 by former municipal official Adrián Armado Pérez Vera. The SCJN’s ruling, published in the Official Gazette of the State of Quintana Roo last Friday, nullifies the requirement for Playa del Carmen residents.

The urban compliance certificate, issued by the Secretariat of Territorial and Urban Sustainable Development (Sedetus), had varying costs depending on property size—ranging from under 100 pesos to over 40,000 pesos.

Legal Implications and Invalidated Provisions

The court’s decision invalidates 17 articles of Quintana Roo’s Law of Human Settlements, Territorial Planning, and Urban Development, five articles of the Urban Actions Law, and one article of the Ecological Balance and Environmental Protection Law. These provisions pertained to the issuance of urban action certificates by the state government.

In its ruling, the SCJN stated: “It was observed that the state Executive Branch’s authority to issue a Territorial Compatibility Certificate violates the exclusive jurisdiction granted to the municipality to authorize, regulate, and oversee land use, as well as to issue construction permits and licenses, as outlined in Article 115.”

Decision Takes Immediate Effect

Although the case was resolved in April, the full effects of the ruling were not enforceable until its official publication. The exemption applies exclusively to Playa del Carmen residents following the successful legal challenge.

The ruling reinforces municipal autonomy in urban planning and construction oversight, marking a significant shift in regulatory authority within Quintana Roo.
