Mexico City — Fonatur Tren Maya, S.A. de C.V., has officially transferred its rights and obligations to Tren Maya, S.A. de C.V. and the Fondo Nacional de Fomento al Turismo (National Fund for Tourism Development), according to an agreement published in the Diario Oficial de la Federación (Official Gazette of the Federation).
Transfer Details and Scope
The agreement establishes the framework for the continuity and oversight of Fonatur Tren Maya’s responsibilities. Tren Maya, S.A. de C.V. will assume obligations directly related to the Tren Maya project, while the Fondo Nacional de Fomento al Turismo will handle all other legal rights, obligations, and unrelated matters.
The Tourism Fund will take over legal proceedings, lawsuits, and contentious administrative processes where Fonatur Tren Maya is involved. However, the agreement specifies that the Fund will subsequently transfer Tren Maya-related obligations to Tren Maya, S.A. de C.V., except for labor disputes, which will remain under the Fund’s jurisdiction.
Implementation Timeline and Responsibilities
The agreement, effective immediately, grants Fonatur Tren Maya and the Tourism Fund a maximum of 30 natural days to formalize the transfer through legal documentation and the handover of relevant records.
Tren Maya, S.A. de C.V. will primarily manage:
- Payment of project estimates
- Cost adjustments and inflation factors for construction
- Supervision of work
- Claims filed by consortiums
- Work orders and project settlements
- Any other expenditures tied to the Tren Maya project
Additionally, Tren Maya will oversee audits and address any inquiries from the Auditoría Superior de la Federación (ASF), Mexico’s federal audit institution. Case files related to legal disputes involving the project must be transferred to Tren Maya by the entities currently holding them.
