Mexico Workers Get Triple Pay for Labor Day: Know Your Rights

Mexico — May 1, recognized as Labor Day in Mexico, is an official holiday under federal law. However, employees required to work on this day are legally entitled to triple their standard daily wage, as stipulated by the Federal Labor Law.

Compensation Requirements for Labor Day

According to Article 75 of the Federal Labor Law, workers who perform duties on mandatory rest days, such as Labor Day, must receive their regular daily salary plus double that amount as additional compensation. For example, an employee earning 1,000 pesos per day should receive 3,000 pesos for working on May 1.

This payment is non-negotiable and legally binding. Workers are advised to review their pay stubs to confirm proper compensation.

Steps to Take If Payment Is Not Received

Employees who do not receive the mandated triple pay may file a complaint with the Federal Labor Defense Office (Profedet). The agency provides free legal counsel and intervenes in cases of employer noncompliance.

Other Mandatory Holidays in 2025

In addition to May 1, the Federal Labor Law designates the following dates as mandatory rest days:

  • September 16 – Independence Day
  • November 20 – Mexican Revolution Day
  • December 25 – Christmas Day

Employees cannot be compelled to work on these holidays unless they voluntarily agree, in which case they must receive the legally required compensation.
